Do we really have Liberty and Freedom?

1/30/2011

I am actually calling all Liberty and Freedom advocates to follow the course of actions needed to pursue our rights.

Thomas Jefferson on Declaration of Independence Rough Draft June 1776:
Picture
"We hold these Truths to be self-evident: that all Men are created equal; that they are endowed by their creator with inherent and certain inalienable rights; that among these are life, liberty, & the pursuit of happiness: that to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed; that whenever any form of government becomes destructive of these ends, it is the right of the people to alter or abolish it, & to institute new government, laying it’s foundation on such principles, & organizing it’s powers in such form, as to them shall seem most likely to effect their safety & happiness." (read more)

We thought that the United States of America or any United Nations country states will automatically give its citizens liberty and freedom but they do not.

We are hampered by laws (liberty trampling, complex, half-hearted and full of loopholes) that were:
  • written by unconcerned law makers
  • interpreted by naive judges
  • exploited by malicious attorneys and lobbyists

Although United States of America have tried to protect against these since its founding and institutionalized:
  • Declaration of Independence
  • Constitution
  • Bill of Rights
  • Constitution Amendments
which did not serve their purposes in reality.

We have laws against individual freedom and these are unconstitutional. Individual freedom is the right to do whatever an individual wanted to, of course, without directly affecting another individual or entity.

So the far-right liberty tramplers will insists that anyone’s action is always directly affecting the society, environment, and even the individual itself. So we need to be protected against ourselves. This is ridiculous at best.

I really think there are precedents (yes, I might sound like a lawyer on using law terms) on law makers awakening to the reality.
  • USA, 18th Amendment was repealed by 21st Amendment
    • Even the 18th Amendment was written not ban the consumption of alcohol, but made it difficult to obtain it legally.
      • This is a half-hearted law against alcohol and law makers like writing laws with loopholes.
    • Even the 21st Amendment was written to repeal the 18th Amendment but it let the states decide on transportation and importation laws for alcohol.
      • Again, this is a half-hearted law that repealed the prohibition on alcohol.
  • USA, under 10th Amendment, as of November 2010, 15 states (Alaska, Arizona, California, Colorado, Hawaii, Maine, Michigan, Montana, Nevada, New Jersey, New Mexico, Oregon, Rhode Island, Vermont, and Washington) have passed legislation which permit the use of medical marijuana.
    • Again this is a half-hearted law, why medical marijuana and not just marijuana?
    • The full-hearted California Proposition 19 would have gone one step further, and legalized marijuana use by persons over age 21 for any purpose whatsoever; however, the state constitutional amendment did not pass, by 4%.
These are the loopholes some confused law makers made to appease the far-right liberty tramplers but gives some liberty to an individual.
  • USA, legal test facility for cockfighting still remains (as cockfighting last bastion in Louisiana was gone by August 2008).
  • USA, Indian Sovereignty give a venue for legal cockfighting
  • USA, Indian Sovereignty give a venue for legal gambling
  • USA, escort services is pseudo for legal prostitution
    • These are honest professional people doing honest professional work.

These taboos, of the society we are living within where liberty is not the priority but traditions and customs; were overcome by equal rights activists through legislation, group action, and just plain personal action.
  • USA, polygamy is not legal but it is practiced in private
    • Laws against polygamy just encourage bigamy where spouses do not know each other.
  • USA, cousin marriage
    • At least 26 states have first cousins marriage as legal and more are underway to revising their laws.
  • USA, gay marriage
    • In Massachusetts, Connecticut, Iowa, New Hampshire, Vermont, and Washington, D.C., marriages for same-sex couples are legal and currently performed.
    • The Coquille Indian Tribe in Oregon also grants same-sex marriage.
    • In New York, Rhode Island, and Maryland, same-sex marriages are recognized, but not performed
These age old sport traditions were under fire by the far-right liberty tramplers who corrupted our society.
  • USA, animal use that are claimed by the far-right liberty tramplers as animal cruelty
    • laboratory animals
    • fishing
    • seals and minks are native population source of food, clothing, shelter
    • gamefowls like pheasant are grown by the government and released for the enjoyment of the hunters
    • cockfighting is the oldest universal sports and archeology found artifacts dating back as far as 10000 BC
    • falconry
    • horse racing
    • bull fighting
    • rodeo
    • race pigeon
    • horse fighting
    • dog fighting
    • dog racing
  • USA, human combat sports nowadays embodied in mixed martial arts
    • I was surprised when John McCain opposed mixed martial arts
These technology driven practicalities are being challenged by the far-right liberty tramplers.
  • USA, genetically modified foods
    • These are what the technology of today and tomorrow ought to be improving upon.
    • Why wait for natural mutation when we can do it now in the laboratories?
  • USA, commercial poultry both layers and broilers
    • These are even targeted by liberty tramplers, what do they want to eat?
  • USA, cloning
    • animals
    • plants
    • humans
Before I drift farther from what I wanted to point out, I will just continue on more details on each topics I presented here in my future blogs.

The only point I want to make is that laws are made to be broken. These laws are written by law makers that are trying to be popular to both the far-right and the common society.

It will be easier if law makers will write laws that are not complex. Complex laws leave a lot of loopholes where anyone can exploit sometimes for the good of the society and the individuals. But most of the times it is exploited by those on the far-right to trample common man’s individual rights.

I actually think that law schools are not needed at all. I do not think of lawyers as an ideal model of integrity nor of common sense. They ought to be eradicated as an academe and profession. If you are a young person and thinking of a profession, my suggestion is anything but law.

I will leave you with these two facts where I have first hand experience:
  • Farmer plants a tree in his own parcel of land and when it’s harvest time the government meddle and tells the farmer he need a logging permit approved
  • Gamecock breeder cares and feeds for the chickens from egg to chicks to cockerels to stags to cocks in his own property then the government meddle and criminalized cockfighting where no one is hurt or directly affected.
These two samples are used here because they both occur in the premise of the owner and creator (planter or breeder) of the said properties namely plants and animals.

I hope the revolutionaries of today in you will fight for LIBERTY and FREEDOM for all of our individual rights.

Note:

Human trafficking and child abuse are against an individual. But prostitution, polygamy, child bride are not against an individual. A child at 2-3 years of age already know when someone abuse or molest them. And they also know who they like to be private with at 7 years of age.

Recently, somewhere in Texas, the polygamous group won the case in court after government agents took some of their kids for alleged child abuse and maybe because of practice of polygamy.

It is sad to say Waco nowadays. We do not think about the place but think about the incident that broke loss after government agents alleged and served warrants against polygamous group which resulted in a big fire consuming the group – adults and children.
